These Website Terms of Service ("Terms") govern the use of our website, the Long Horizon desktop application and related client software (the "Software"), and related hosted services (collectively, the "Services") provided by our company and its subsidiaries, representatives and affiliates (collectively, "Long Horizon", "we", "us" or "our") whether you are a paying customer or a non-paying visitor. These Terms, and any other terms and policies referred to in these Terms, form an agreement between Long Horizon and you (referred to as "Customer" or "you").

Please also read our Privacy Policy, which explains how we collect and use your personal information. These Terms govern your access to our Services, including our website, Software, notifications, and materials or content appearing therein.

1. About us and our Services

1. We are Imarti Creations Private Limited, a company registered in Delhi, India, operating the Long Horizon product.

2. Long Horizon provides AI-assisted browser testing tools, including a desktop application you install on your computer to run tests, author and manage test assets, interact with coding agents via MCP, and generate shareable execution reports. Hosted services may include account management, billing, report hosting, and related infrastructure.

2. Desktop Software

1. Parts of the Services require you to download and install the Software on a compatible computer. You are responsible for ensuring your system meets any stated requirements, keeping the Software updated when prompted, and maintaining the security of the device on which the Software runs.

2. The Software may access local project files, browsers, and network interfaces as needed to run tests you configure. You are responsible for authorizing such access and for any data processed from your machine in connection with your use of the Services.

3. We may deliver updates, patches, or replacements to the Software. Continued use after an update may be required for compatibility or security. If you do not agree to updated Terms, you must stop using the Services and uninstall the Software.

3. Acceptance

1. Long Horizon owns, or holds the relevant rights to, the website and Software and grants you a non-exclusive license to use them in accordance with these Terms.

2. This Agreement is binding from the time we provide you with access to the Services (including account creation or first use of the Software), referred to as the "Effective Date".

3. By accessing and/or using the website and/or Software you:

  • warrant that you have reviewed these Terms and our Privacy Policy (available on the site);
  • warrant that you have the legal capacity to enter into this Agreement or, if you accept on behalf of an organization, that you have authority to bind that organization;
  • warrant that your use will comply with these Terms and applicable laws;
  • warrant that you will not use the Services for any illegal or unauthorized purpose;
  • acknowledge that the Services are provided on an "as is" and "as available" basis and that your use is at your sole risk.

4. License to use

Subject to your compliance with these Terms, Long Horizon grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business or personal purposes. This license does not include any right to:

  • Resell or sublicense the Services
  • Use the Services to build a competitive product or service
  • Reverse engineer, decompile, or disassemble the Services except where prohibited by law
  • Remove or alter any proprietary notices or labels

5. User accounts and registration

To access certain features, you may need to create an account. You agree to provide accurate information, maintain the security of your credentials, accept responsibility for activity under your account, notify us of unauthorized use, and sign out where appropriate on shared devices. Long Horizon is not liable for loss arising from your failure to comply.

6. Acceptable use

You agree not to use the Services to:

  • Violate applicable laws, regulations, or third-party rights
  • Infringe intellectual property rights of Long Horizon or others
  • Transmit malicious code, viruses, or harmful content
  • Interfere with or disrupt the Services or connected networks
  • Attempt unauthorized access to the Services, other accounts, or systems
  • Use the Services to send spam or unsolicited bulk communications
  • Run automated tests or interactions against systems you do not own or lack permission to test, or in a way that violates third-party terms
  • Process or store unlawful data or data you have no right to use

7. Intellectual property

The Services and their original content, features, and functionality are owned by Long Horizon and protected by applicable intellectual property laws.

You retain ownership of tests, code, and content you create. By using the Services, you grant Long Horizon a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely to provide and improve the Services.

8. Payment terms

If you purchase a paid plan: you agree to pay all fees, billing may be in advance, fees are non-refundable except as required by law or our Refund Policy, we may change pricing with notice, we may suspend access for non-payment, and you are responsible for applicable taxes.

9. Usage limits

Your plan may include limits on test runs, seats, report hosting, storage, or other usage. We may enforce fair-use or technical limits to protect reliability. Exceeding limits may require upgrading, waiting for a reset period, or may result in throttling or suspension as described in your plan or in-product notices.

10. Data and content

You are solely responsible for the accuracy, quality, and legality of data and content you upload or process, ensuring you have rights to use that data, complying with privacy laws, and maintaining backups. Long Horizon is not responsible for loss or corruption of your data.

11. Third-party services

The Services may integrate with third parties (including browsers, version control, AI providers, and identity or payment providers). Your use of those services is subject to their terms. We are not responsible for third-party availability or behavior beyond what we expressly commit to in writing.

12. Limitation of liability

To the fullest extent permitted by law: Long Horizon is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or business; our total liability for claims relating to the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim; some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Long Horizon and its officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of others' rights.

14. Service availability and modifications

We strive for reliability but do not guarantee uninterrupted access. We may perform maintenance, modify features, or discontinue portions of the Services. You have no claim against us for such changes except where required by law.

15. Right to terminate

We may suspend or terminate your access for breach of these Terms or as required by law, subject to any notice we are permitted to give.

16. Severance

If any provision is void or unenforceable, it is severed to that extent and the remainder remains in effect.

17. Governing law and jurisdiction

These Terms are governed by the laws of India. You submit to the exclusive jurisdiction of the courts in India for disputes arising from or relating to these Terms, subject to mandatory consumer protections in your jurisdiction where applicable.

18. Termination

1. These Terms apply until terminated by you or us.

  • You may stop using the Services and delete or uninstall the Software.
  • We may suspend or terminate access if we reasonably believe you are in serious or repeated breach, pose a risk of harm, are required to do so by law, or continued provision is no longer commercially viable.

2. Where permitted, we will notify you at the email associated with your account or at next sign-in.

3. Upon termination, these Terms terminate except provisions that should survive.

19. Changes to Terms

We may modify these Terms at any time by posting updates on this page and changing the "Last updated" date. Continued use after changes constitutes acceptance. If you disagree, stop using the Services and uninstall the Software.
